O presente trabalho pretende abordar acerca da do di\u00e1logo interjudicial estabelecido
\nentre os tribunais brasileiros e Corte Interamericana de Direitos Humanos no exerc\u00edcio
\ndo controle de convencionalidade, bem como a rela\u00e7\u00e3o entre os tribunais nacionais e a
\nCorte Interamericana de Direitos Humanos em mat\u00e9ria de reconhecimento e
\ncumprimento por aqueles das decis\u00f5es internacionais desta. Visa, ainda, expor os
\ninstrumentais normativos internos que imp\u00f5em esta intera\u00e7\u00e3o e os desafios para firmarse
\num marco regulat\u00f3rio sobre a mat\u00e9ria. A problem\u00e1tica consiste em solucionar os
\nseguintes questionamentos: a Corte Interamericna de Direitos Humanos, com base na
\nConven\u00e7\u00e3o Americana, instituiu um controle difuso de convencionalidade? Em que
\nmedida a teoria do controle de convencionalidade imprime um di\u00e1logo interjudicial
\nvinculante para os tribunais nacionais? E por fim, \u00e9 poss\u00edvel o reconhecimento da
\nexecutoriedade direta das decis\u00f5es proferidas em sede de jurisdi\u00e7\u00e3o interamericana para
\nprote\u00e7\u00e3o dos direitos humanos? Nossa hip\u00f3tese se baseia nas diferen\u00e7a entre a natureza
\njur\u00eddica, o procedimento e a efic\u00e1cia de uma decis\u00e3o estrangeira e de uma decis\u00e3o
\ninternacional, bem como na imperativa seguran\u00e7a jur\u00eddica transnacional dos direitos
\nhumanos. A problem\u00e1tica consiste, tamb\u00e9m, em averiguar: quais as poss\u00edveis fun\u00e7\u00f5es
\ndos \u00f3rg\u00e3os judiciais brasileiros para desenvolver internamente o sistema interamericano
\nde direitos humanos? A metodologia empregada no presente trabalho \u00e9 a an\u00e1lise
\ndoutrin\u00e1ria e jurisprudencial sobre o tema.<\/p>\n
ABSTRACT:
\nThis paper aims to address about the interjudicial dialogue established between the
\nBrazilian courts and Inter-American Court of Human Rights in the exercise of
\nconventionality control, and the relationship between national courts and the Inter-
\nAmerican Court of Human Rights on the recognition and enforcement by those of
\ninternational decisions this. It also aims to expose the internal regulatory instruments
\nthat impose this interaction and challenges to firm up a regulatory framework in this
\narea. The problem is to solve the following questions: a Interamericna Court of Human
\nRights, based on the American Convention imposed a diffuse control of
\nconventionality? To what extent the conventionality of control theory prints a
\ninterjudicial binding dialogue to national courts? Finally, recognition of the direct enforceability of judgments in inter-American jurisdiction thirst for human rights
\nprotection possible? Our hypothesis is based on the difference between the legal nature
\nof the procedure and the efficacy of a foreign judgment and an international decision
\nand the imperative transnational legal certainty of human rights. The issue is also to
\nascertain: what possible functions of the Supreme Court, as the national court to
\ninternally develop the inter-American human rights system? The methodology used in
\nthis work is the doctrinal and jurisprudential analysis on the topic.<\/p>\n
