RESUMO
\nO presente estudo analisa a potencial natureza supralegal da Conven\u00e7\u00e3o Interamericana
\nde Direitos Humanos face a supranacionalidade das normas de Direitos Humanos.
\nAborda ainda o dissenso entre a doutrina e a jurisprud\u00eancia brasileira sobre o assunto.
\nAssim, a hip\u00f3tese que se toma \u00e9 de que, por fim, o Pacto de San Jose da Costa Rica, em
\nraz\u00e3o de seu conte\u00fado eminentemente de direitos humanos, possui natureza
\nconstitucional, apesar das decis\u00f5es tomadas pela corte maior do Brasil.<\/p>\n
ABSTRACT:
\nThis study analyzes the potential supralegal nature of Inter-American Convention face
\nthe supranationality of the norms of Human Rights. Also addresses the disagreement
\nbetween the doctrine and the Brazilian jurisprudence on the subject. Thus, the
\nhypothesis that is taken is that, finally, the Pact of San Jos\u00e9 of Costa Rica, because of its
\neminently human rights content, has constitutional nature, despite the decisions taken by
\nthe higher court of Brazil.<\/p>\n
